Privacy Policy
This Privacy Policy describes how Tobination LLC, a South Dakota limited liability company (“Tobination,” “we,” “us,” or “our”), collects, uses, and protects information when you visit tobination.com(the “Site”) or interact with our forms and services. We aim to be straightforward about what we do and don’t do with your data.
1. Who we are
Tobination LLC is the data controller for the personal information described in this policy. The owner of the business is Scott Tobin. You can reach us through our contact page.
2. Information we collect
We collect personal information only when you choose to give it to us. Specifically:
- Contact form. When you submit our contact form, we collect the fields you provide: first name, last name, email, optional phone number, optional company or project name, optional website link, and the content of your message.
- AI Concierge intake form. When you submit the intake form for our AI Concierge service, we collect practice information (name, website, location, type of practice), contact details, your responses to the workflow questions, and your timeline and tier preferences.
- Lead-magnet downloads. When you request a downloadable resource, we collect your name, email, and optional practice or company name so we can send the file and follow up if relevant.
We don’t require you to create an account, and the Site has no comments, user profiles, or login.
3. How we use your information
We use the information you submit to:
- respond to your inquiry or intake;
- scope, propose, and deliver work if we agree to engage;
- deliver any free resource or download you specifically requested;
- keep records of business correspondence as required for tax, legal, and accounting purposes.
We don’t sell or rent your personal information. We don’t run a marketing newsletter or add your email to any third-party promotional list.
4. How forms are processed
Form submissions are sent over an encrypted HTTPS connection to our hosting provider, then dispatched as transactional email by Resend to a private inbox monitored by Scott Tobin. Each form is protected against automated submissions by Cloudflare Turnstile, which inspects non-personal browser signals to distinguish humans from bots. Turnstile does not track you across sites and does not place advertising cookies.
5. Service providers
We use a small number of providers to operate the Site and email workflows. Each one processes only the data necessary to provide its service.
- Vercel — site hosting, build infrastructure, Vercel Analytics, and Vercel Speed Insights.
- Google — Google Tag Manager (container
GT-NS43GF2Q) which loads Google Analytics 4. - Resend — transactional email delivery for form submissions.
- Cloudflare — Turnstile spam protection on form submissions.
6. Analytics and cookies
We load Google Tag Manager (container GT-NS43GF2Q) on every page. GTM in turn loads Google Analytics 4, which collects anonymized usage data: page views, referrer, approximate location (country and region only — never street-level), device type, browser, and session duration. GA4 sets first-party cookies in your browser to identify a returning visitor across pages within the same session. We do not enable GA4’s advertising-personalization features, and the Site does not load remarketing or third-party ad-network pixels.
We also use Vercel Analytics and Vercel Speed Insights alongside GA4. These tools collect anonymized, aggregated metrics such as page views, referrers, country, device type, and Core Web Vitals. They do not use cookies and do not collect personally identifying information.
Cloudflare Turnstile remains in place as the bot-prevention layer on every form. Turnstile inspects non-personal browser signals to distinguish humans from bots and does not track you across sites.
What we don’t do. No advertising pixels. No remarketing. No third-party ad networks. No user-level data is sold or shared for cross-context behavioral advertising.
How to opt out. If you prefer not to be counted in our analytics: install a content blocker like uBlock Origin or Privacy Badger; enable your browser’s “Do Not Track” setting; or install Google’s official Google Analytics Opt-out Browser Add-on. Any of these will prevent GA4 from recording your visit.
7. Data retention
We retain form submissions and email correspondence for as long as necessary to support an active or potential engagement, and thereafter only as required by law or for legitimate business recordkeeping. You can request deletion at any time through our contact page.
8. Your rights
Depending on where you live, you may have the right to access, correct, port, or delete the personal information we hold about you, or to restrict or object to certain processing. California residents have rights under the CCPA, and residents of the EU and UK have rights under the GDPR. To exercise any of these rights, submit a request through our contact page. We will respond within the timeframes required by applicable law.
We don’t sell or share personal information for cross-context behavioral advertising, so there is no opt-out to make on that front.
9. Children
Tobination’s services are not directed to children under 16, and we don’t knowingly collect information from children. If you believe a child has submitted information, contact us and we will delete it.
10. Security
We use reasonable administrative and technical safeguards appropriate to a small business operating on modern hosted infrastructure. No system is perfectly secure, however, and we cannot guarantee absolute security of information transmitted to or stored on the Site.
11. International transfers
Tobination is based in the United States, and our service providers may process data in the United States and other countries. By using the Site or contacting us, you understand that your information may be transferred to the United States.
12. Changes to this policy
We may update this Privacy Policy from time to time. The “Last updated” date at the top reflects the most recent changes. Material changes will be reflected on this page; continued use of the Site after changes are posted means you accept the updated policy.
