Terms and Conditions
These Terms and Conditions (the “Terms”) govern your use of tobination.com(the “Site”) and any services provided by Tobination LLC, a South Dakota limited liability company (“Tobination,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree with any part of them, please do not use the Site.
1. About Tobination
Tobination is a venture lab and advisory practice founded by Scott Tobin. The Site describes our work, ventures, advisory positioning, and a productized AI Concierge offering for aesthetic practices. Submitting any form on the Site does not create a contract for services; engagements are formed only through a separate written agreement signed by both parties.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract under applicable law to use the Site. By using the Site, you represent and warrant that you meet these requirements.
3. Site content and intellectual property
All text, design, code, images, logos, ventures references, and other content on the Site are owned by Tobination LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may view and share the Site for personal, non-commercial purposes. You may not copy, scrape, republish, sell, or create derivative works of the Site without our prior written permission.
AI search systems and crawlers (including OpenAI’s GPTBot, Anthropic’s ClaudeBot, Perplexity, Common Crawl, and similar) are permitted to index and quote from the Site for the purpose of answering user queries with appropriate attribution. Pages on the Site are also indexed in our LLM index.
4. Acceptable use
You agree not to:
- use the Site to violate any law or third-party right;
- submit false, misleading, or fraudulent information through any form on the Site;
- attempt to interfere with, probe, or compromise the Site’s infrastructure, security, or other users;
- attempt to bypass our spam protection or make automated submissions of any form on the Site;
- impersonate another person or misrepresent your affiliation with any person or organization.
5. AI Concierge engagements
Pricing for AI Concierge tiers is shown on the AI Concierge pagein U.S. dollars. Submitting the intake form is not a purchase or a binding offer. After we review your submission, we will send a payment link only if we’ve confirmed fit and capacity. All engagements are governed by a separate engagement letter that includes scope, deliverables, timing, payment terms, and any specific warranty or refund terms applicable to that engagement.
Where an engagement letter conflicts with these Terms, the engagement letter controls for the work it covers.
6. Forms, communications, and consent
When you submit a form on the Site, you consent to receive email correspondence in response. We do not add you to a marketing list, send newsletters, or sell your contact information. See our Privacy Policy for the full description of how we handle data submitted through forms.
7. Third-party links
The Site links to third-party websites for our ventures and partners (for example, ringloapp.com, mysurgeryquote.com, smartgringo.com). We are not responsible for content, privacy practices, or terms on third-party sites. Following an external link is at your own risk.
8. Disclaimers
The Site and any informational content on it are provided “as is” and “as available” without warranties of any kind, either express or implied. Articles, the blog, and other written content on the Site are for general information only and do not constitute legal, medical, financial, or professional advice. To the fullest extent permitted by applicable law, Tobination disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by applicable law, Tobination LLC and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site, including but not limited to loss of profits, data, or business opportunity, even if we have been advised of the possibility of such damages.
Our aggregate liability arising out of or relating to the Site, in the absence of a separate written engagement, will not exceed one hundred U.S. dollars (US $100). Where a separate engagement letter exists, the liability provisions of that engagement letter control.
10. Indemnification
You agree to indemnify, defend, and hold harmless Tobination LLC and its members, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any third-party right.
11. Governing law and disputes
These Terms are governed by the laws of the State of South Dakota, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in South Dakota, and you consent to the personal jurisdiction of those courts. The federal Arbitration Act applies to any agreement to arbitrate that may exist in a separate engagement letter.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent changes. Material changes will be reflected on this page; your continued use of the Site after changes are posted means you accept the updated Terms.
13. Severability and entire agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with any engagement letter and our Privacy Policy, constitute the entire agreement between you and Tobination regarding your use of the Site.
